Q: Does my company need to have a Legionella risk assessment?
A: If you have more than 5 employees or serve the general public then you should have a Legionella risk assessment carried out to comply with the law.

Q: I need a Legionella risk assessment, who should carry this out?
A: As someone in control of premises it is your responsibility to manage health & safety and Legionella control is included in this. You can either appoint yourself, somebody who works for the company or an outside company to do this for you.

A: The legal requirements for landlords and managing agents are to ensure that the tenant's risk from exposure to Legionella from water systems in residential rental property is safely controlled.

Landlords are classed as persons who are in control of premises. Therefore the HSE states that under the Health and Safety at Work Act 1974, landlords have legal and health and safety duties, to take suitable precautions to prevent or control the risk of exposure to legionella.
